These Terms of Service govern the use of the emerce website, accessible at emerce.store (hereinafter: the "Service"), operated by:

• Service — the emerce website available at emerce.store, including the AI Ready Check tool and the AI Readiness Report.
• Operator — BTA SYSTEMS SP. Z O.O., the entity providing the Service.
• User — any natural person, legal entity, or organizational unit using the Service.
• AI Ready Check — the free public tool that analyzes a submitted store URL and returns a partial readiness score and a short list of findings.
• AI Readiness Report — the full audit report sent by email to the address provided by the User after running the AI Ready Check.

3. Conditions of Use

3.1. By using the Service, you accept these Terms of Service in full.

3.2. You agree to use the Service in compliance with applicable law and these Terms.

3.3. The Service does not currently offer user accounts; no registration is required to view the website or to run an AI Ready Check.

3.4. To receive the AI Readiness Report by email you must provide a valid email address that you are authorized to use.

3.5. You agree not to abuse the AI Ready Check tool (e.g., automated scraping, bulk submissions of URLs you do not own or are not authorized to test). The Operator may rate-limit or block requests that appear to violate this rule.

4. AI Readiness Report

4.1. The AI Readiness Report is provided free of charge for informational purposes only.

4.2. By submitting your email address through the report request form, you instruct the Operator to send the corresponding report to that address. This instruction is the legal basis for processing your email under Art. 6(1)(b) GDPR (performance of a service requested by you).

4.3. If you additionally tick the marketing consent checkbox, you also consent to receive occasional emerce product updates and insights. You can withdraw this consent at any time using the unsubscribe link in any such message or by emailing [email protected].

4.4. The findings in the report are generated automatically based on publicly accessible signals on the analyzed URL at the time of the check. They are a best-effort technical assessment, not a guarantee of compliance, ranking, or commercial outcome.

5. Liability

5.1. The Operator makes reasonable efforts to ensure the Service operates correctly but does not guarantee uninterrupted or error-free operation.

5.2. The Operator shall not be liable for damages resulting from use of the Service in violation of these Terms, nor for business decisions taken solely on the basis of an AI Readiness Report.

6. Intellectual Property

6.1. All intellectual property rights to the Service, including graphics, software, the audit logic, the report layout, and the database of findings, belong to BTA SYSTEMS SP. Z O.O. or its licensors.

6.2. You may share an AI Readiness Report you receive in unmodified form for internal business purposes. Any other reproduction, redistribution, or commercial use of the Service or its outputs requires the Operator's prior written consent.

7. Final Provisions

7.1. The Operator reserves the right to amend these Terms. Material changes will be communicated through a notice on the Service.

7.2. Matters not covered by these Terms shall be governed by the laws of Poland.

7.3. Any disputes arising from the use of the Service shall be resolved by the court having jurisdiction over the Operator's registered office.
